Welcome to Anderson Outdoor Incorporated ("AOI," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our services, website, and communications, including text messaging. By engaging our services or submitting a form on our website, you agree to be bound by these Terms. Please read them carefully.

Anderson's Outdoor Creations, Inc., doing business as Anderson Outdoor Incorporated, is a licensed design-build outdoor construction company based in Fredericksburg, Texas. We specialize in custom landscape design, hardscaping, irrigation systems, outdoor living construction, dirt work, welding, and related construction services throughout the Texas Hill Country.

  1. Text Messaging (SMS/MMS) Communications

Program Name: Anderson Outdoor Incorporated SMS Communications

Program Description: AOI uses text messaging (SMS and MMS) to communicate with clients regarding project scheduling, appointment reminders, project updates, service notifications, estimates, invoicing, and general business communications related to the services you have requested or engaged.

2a. Consent and Opt-In

We send text messages only to people who have opted in. You can opt in in either of these ways: (1) checking the optional, unchecked text message consent box on our Text Messaging Sign-Up page at https://www.andersonoutdoorinc.com/text-messaging; or (2) saying yes when our team member asks, on a phone call with our office, whether we may text you appointment reminders and project updates at your number. Giving us your phone number for any other reason does not by itself opt you in to the text messaging program described in these Terms. Consent to receive text messages is not a condition of purchasing any goods or services from AOI. When you opt in, you agree to receive text messages (SMS and MMS) from Anderson Outdoor Incorporated about your request and project, including appointment and site visit reminders, schedule updates, and estimate and invoice notices.

2b. Message Frequency

Message frequency varies based on the nature and status of your project and your interactions with our team. You may receive messages related to appointment confirmations, scheduling changes, project status updates, payment reminders, and responses to your inquiries.

2c. Message and Data Rates

Standard message and data rates may apply to any text messages sent to or received from AOI, depending on your mobile carrier and your wireless plan. AOI is not responsible for any charges incurred by your mobile carrier for text messaging services.

2d. Opt-Out Instructions

You may opt out of receiving text messages from AOI at any time by replying STOP to any text message you receive from us. Upon receiving your opt-out request, we will send a confirmation message acknowledging that you have been unsubscribed. After opting out, you will no longer receive text messages from AOI unless you re-subscribe. Opting out of text messages does not cancel any existing service agreements or projects.

2f. Sharing of Mobile Information

No mobile information, including phone numbers and text messaging opt-in data, will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except as required to facilitate the delivery of text messages through our messaging service providers (aggregators and providers of text message services) or as required by law.

  1. Liability and Disclaimers

AOI is not responsible for any delays, failures in delivery, or any other issues related to the transmission or receipt of text messages. Delivery of text messages is subject to effective transmission by your mobile carrier and is not guaranteed by AOI. By subscribing to our SMS services, you acknowledge and agree that AOI will not be liable for any damages, losses, or injuries arising from or related to the use or failure to receive any text messages, including but not limited to delays, non-delivery, or erroneous content. AOI does not charge for text messages, but standard message and data rates from your carrier may apply. AOI reserves the right to modify or discontinue its text messaging program at any time without prior notice. Carriers are not liable for any delayed or undelivered messages.

Our Text Messaging Sign-Up page (https://www.andersonoutdoorinc.com/text-messaging) has an optional consent box that is unchecked by default. We text a number submitted there only if the box is checked. Message and data rates may apply. Message frequency varies. Reply STOP to unsubscribe at any time. Reply HELP for assistance. Our separate work request form on the Contact page is provided by Jobber. Visit reminders and other transactional texts sent through Jobber follow the text messaging disclosure shown on that form, and are separate from the Anderson Outdoor Incorporated text messaging program described in these Terms.
